Terms and conditions for using GetQRFree's QR code services

Welcome to GetQRFree

These Terms of Service ("Terms") govern your access to and use of GetQRFree's QR code generation and management services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

Please read these Terms carefully, especially the sections regarding:

  • Subscription and billing (Section 4)
  • Service limitations and interruptions (Section 6)
  • Limitation of liability (Section 11)

1. Service Overview

GetQRFree provides two types of services:

1.1 Free Static QR Code Generator

  • No registration required - Generate static QR codes instantly
  • Local processing - Your QR code content is processed in your browser
  • Unlimited generations - Create as many static QR codes as you need
  • Multiple formats - Download in PNG, JPEG, SVG, or WEBP

1.2 Paid Dynamic QR Code Service

  • Registration required - Requires account creation via Google authentication
  • Server-based - QR codes and analytics are stored on our servers
  • Subscription-based - Available through paid subscription plans
  • Usage-based pricing - Includes base quota with overage charges

2. Account Registration and Security

2.1 Account Creation

To use the paid Dynamic QR Code Service, you must:

  • Create an account using Google OAuth authentication
  • Provide accurate and complete information
  • Be at least 18 years old or have parental/guardian consent
  • Use only one account per person or entity

2.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your Google account security

2.3 Account Sharing

Accounts are personal and may not be shared, sold, or transferred to others. Each user must have their own account.

3. Subscription Plans

3.1 Available Plans

GetQRFree offers the following subscription tiers:

Annual subscriptions are available at a discount (equivalent to 10 months).

3.2 Plan Features and Limitations

Each plan includes specific features and limitations as described on our pricing page. Features may include:

  • Number of dynamic QR codes
  • Monthly scan quota
  • Data retention period
  • Custom domain support
  • CSV batch import
  • API access

3.3 Plan Changes

  • Upgrades: Take effect immediately with prorated billing
  • Downgrades: Take effect at the next billing cycle
  • Feature adjustment: When downgrading, features exceeding the new plan limits may be restricted

4. Billing and Payment

4.1 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your designated payment method.

4.2 Subscription Billing Cycle

  • Subscriptions are billed monthly or annually, depending on your selection
  • Billing occurs on the same day each month/year as your initial subscription
  • All fees are in US Dollars (USD)

4.3 Automatic Renewal

IMPORTANT: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW at the end of each billing period unless you cancel before the renewal date.

  • You will be charged automatically on each renewal date
  • Renewal will be at the then-current subscription rate
  • You may cancel at any time through your account settings or by contacting us
  • Cancellation takes effect at the end of your current billing period

4.4 Overage Charges

When your scan usage exceeds your plan's base quota, overage charges apply:

Overage charges are calculated monthly and billed together with your subscription.

4.5 Spending Cap

To protect you from unexpected charges, each plan includes a configurable spending cap:

  • Purpose: Limits your maximum monthly overage charges
  • Default values: Solo ($10), Micro ($30), Pro ($50)
  • Adjustable: You can modify this at any time in your settings
  • Set to $0: No overage charges, service pauses at quota

4.6 Behavior When Spending Cap is Reached

YOU CHOOSE what happens when you reach your spending cap:

Option A: Pause QR Code Redirects (Default for Solo/Micro)

  • Your dynamic QR codes will stop redirecting to target URLs
  • Charges are frozen at your spending cap
  • Service resumes when you increase your cap or the next billing cycle begins

⚠️ WARNING: If you select this option, your QR codes may become temporarily non-functional when the spending cap is reached. GetQRFree is not responsible for any business interruption or losses resulting from this service pause.

Option B: Continue Redirects, Notify Only (Default for Pro)

  • Your QR codes continue working normally
  • We send email notifications at key thresholds (50%, 80%, 100% of cap)
  • Overage charges continue to accrue without limit
  • You remain responsible for all charges incurred

4.7 Taxes

All fees are exclusive of applicable taxes. You are responsible for any taxes, duties, or governmental assessments associated with your use of the Service.

4.8 Price Changes

We may change our prices at any time. Price changes for existing subscriptions will take effect at the next billing cycle following at least 30 days' notice to you.

4.9 Refund Policy

Our refund policy for subscriptions, credit packages, and overage charges is governed by our separate Refund Policy, which is incorporated by reference into these Terms.

Important Notes:

  • Refund requests must be submitted within the applicable time period
  • Service access terminates immediately upon refund approval
  • Billing disputes must be raised within 30 days of the charge
  • Abuse of the refund policy may result in account restrictions

5. Your Content and Data

5.1 Ownership of Your Content

You retain all ownership rights to any content you create, upload, or submit through the Service, including but not limited to:

  • QR code target URLs and content
  • LinkPage content and design
  • Uploaded logos, images, and PDFs
  • vCard contact information
  • WiFi credentials

5.2 License to GetQRFree

By using the Service, you grant GetQRFree a limited, non-exclusive, worldwide license to:

  • Store and process your content to provide the Service
  • Generate QR codes based on your specifications
  • Display your content through your QR codes as intended
  • Create backups and maintain service reliability

This license terminates when you delete your content or close your account.

5.3 Content Restrictions

You may not use the Service to create QR codes that link to or contain:

  • Illegal content or activities
  • Malware, viruses, or phishing attempts
  • Content that infringes intellectual property rights
  • Harmful, abusive, or harassing content
  • Spam or unauthorized advertising
  • Adult content without proper age verification
  • Content promoting violence or discrimination

5.4 Our Content

The GetQRFree website, software, design, trademarks, and documentation remain our intellectual property. Your use of the Service does not grant you any ownership of these assets.

6. Service Availability and Limitations

6.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unplanned outages or technical issues
  • Force majeure events
  • Third-party service disruptions

6.2 Free Service Limitations

The Free plan is provided "as is" with limited support. We reserve the right to:

  • Limit usage to prevent abuse
  • Pause service after scan quota is exceeded
  • Modify free plan features with reasonable notice

6.3 Paid Service Availability

For paid plans, we target 99.5% uptime but provide no formal SLA guarantee. Service interruptions may still occur.

6.4 Spending Cap Service Interruption

IMPORTANT ACKNOWLEDGMENT: By using the Service with "Pause QR Code Redirects" enabled, you acknowledge and accept that:

  1. Your QR codes WILL stop working when the spending cap is reached
  2. This may occur at any time during a billing cycle
  3. Scanned QR codes will display a notice rather than redirect
  4. GetQRFree bears NO responsibility for any losses, damages, or business interruption caused by this service pause
  5. You are solely responsible for monitoring your usage and adjusting your settings accordingly

If uninterrupted service is critical to your operations, we recommend:

  • Setting a higher spending cap
  • Selecting "Continue Redirects, Notify Only" mode
  • Upgrading to a higher-tier plan with larger quotas

We reserve the right to change our redirect domain structure. If such changes occur, we will provide at least 90 days' notice and offer migration assistance.

7. Data Retention and Deletion

7.1 Analytics Data Retention

Scan analytics data is retained according to your plan:

Data older than your retention period is automatically deleted.

7.2 Account Data

Your account information, QR codes, and associated content are retained while your account is active.

7.3 Plan Downgrade

When downgrading to a plan with shorter data retention:

  • Analytics data exceeding the new retention period will be deleted
  • A 30-day grace period is provided for data export
  • QR codes exceeding the new plan limit will be deactivated (not deleted)

7.4 Account Cancellation

Upon account cancellation:

  • Your subscription ends at the current billing period's end
  • You retain read-only access for 30 days
  • After 30 days, your data is scheduled for permanent deletion
  • Deletion is typically completed within 90 days

7.5 Data Deletion Requests

You may request deletion of your data at any time. We will process deletion requests within 30 days, subject to any legal retention requirements.

7.6 Data Export

You may export your QR code data and analytics at any time through your account dashboard. We recommend exporting your data before canceling your account.

8. Fair Use Policy

8.1 Definition of Abuse

The following activities are considered abuse of the Service:

  • Automated bulk creation of QR codes beyond reasonable use
  • Using QR codes for spam, phishing, or malicious purposes
  • Attempting to circumvent usage limits or billing
  • Generating excessive server load through automated requests
  • Reselling access to free services
  • Creating QR codes for illegal activities

8.2 Enforcement

When abuse is detected:

  1. First occurrence: Warning notification with 48 hours to remedy
  2. Continued violation: Service restriction or suspension
  3. Severe or repeated violation: Account termination without refund

8.3 Appeal Process

If you believe an enforcement action was made in error, you may appeal by contacting support@getqrfree.com within 14 days.

9. Custom Domains

9.1 Domain Verification

To use custom domains, you must:

  • Own or control the domain
  • Complete DNS verification as instructed
  • Maintain proper DNS configuration

9.2 Domain Responsibility

You are responsible for:

  • Domain registration and renewal
  • DNS configuration and management
  • SSL certificate provisioning (handled automatically by our service)
  • Ensuring domain does not infringe others' rights

9.3 Domain Removal

Custom domains may be removed from the Service if:

  • DNS verification fails for extended periods
  • The domain is used for prohibited content
  • Your subscription no longer includes custom domain support

10. Third-Party Services

10.1 Payment Processing

We use Stripe for payment processing. Your use of Stripe is subject to Stripe's Terms of Service.

10.2 Authentication

We use Google OAuth for authentication. Your use is subject to Google's Terms of Service.

10.3 Infrastructure

The Service relies on third-party infrastructure providers (including Cloudflare). Service interruptions caused by these providers are beyond our control.

10.4 Linked Content

QR codes you create may link to third-party websites. We are not responsible for the content, privacy practices, or availability of third-party sites.

11. Disclaimers and Limitation of Liability

11.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Guarantee of Results

We do not guarantee that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, or error-free
  • QR codes will always function correctly
  • Analytics data will be 100% accurate

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  1. Cap on Damages: Our total liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

  2. Exclusion of Damages: We are NOT liable for any:

    • Indirect, incidental, special, or consequential damages
    • Lost profits, revenue, or business opportunities
    • Lost data or data corruption
    • Business interruption
    • Damages resulting from spending cap enforcement
    • Damages caused by third-party services
  3. QR Code Reliance: You acknowledge that QR codes should not be your sole means of communication or business operation. We recommend maintaining backup methods for critical operations.

11.4 Indemnification

You agree to indemnify and hold harmless GetQRFree and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Content you create or distribute via the Service

12. Termination

12.1 Termination by You

You may terminate your account at any time through your account settings. Upon termination:

  • Your subscription continues until the end of the current billing period
  • No refunds are provided for remaining subscription time
  • Data handling follows Section 7.4

12.2 Termination by GetQRFree

We may terminate or suspend your account immediately if:

  • You violate these Terms
  • You engage in fraudulent or abusive behavior
  • We are required to do so by law
  • We discontinue the Service

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ends immediately
  • Outstanding charges remain due
  • Sections 5.4, 11, 12.3, and 13 survive termination

13. General Provisions

13.1 Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of laws principles.

13.2 Dispute Resolution

Any disputes arising from these Terms shall be resolved through:

  1. Good faith negotiation between the parties
  2. Mediation, if negotiation fails
  3. Binding arbitration under AAA Commercial Arbitration Rules

Class action lawsuits and class-wide arbitration are waived to the extent permitted by law.

13.3 Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Cookie Policy, and any applicable pricing information, constitute the entire agreement between you and GetQRFree.

13.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

13.5 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision.

13.6 Assignment

You may not assign your rights or obligations under these Terms. We may assign our rights and obligations without restriction.

13.7 Modifications to Terms

We may modify these Terms at any time. Material changes will be notified at least 30 days in advance via:

  • Email to your registered address
  • Prominent notice on our website

Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

13.8 Enterprise Agreements

Enterprise customers may be subject to separate written agreements that supersede these Terms.
